1. Agreement to Terms
These Terms of Service (“Terms”) govern your use of kristinrivas.com (“Website”) and the services provided by Kristin Rivas, LLC (“Company,” “we,” “us,” or “our”), a Tennessee limited liability company. By accessing or using our Website, scheduling a consultation, purchasing services, or engaging with us in any capacity, you (“Client,” “you,” or “your”) agree to be bound by these Terms.
If you do not agree with these Terms, do not use this Website or purchase our services. We reserve the right to update these Terms at any time. Material changes will be posted on this page with an updated effective date. Your continued use of the Website after changes constitutes acceptance of the revised Terms.
2. Nature of Services
Kristin Rivas is a Certified Hypnotherapist (C.Ht.) through the National Guild of Hypnotists, a Certified Brain Health Coach through Amen Clinics, a qualified Rapid Resolution Therapy® (RRT®) Specialist, and a Practitioner of Neuro-Linguistic Programming (NLP).
Services offered include: Hypnotherapy, Brainspotting, Rapid Resolution Therapy®, Neuro-Linguistic Programming, and Brain Health Coaching, delivered primarily via secure video call.
Non-Medical Disclaimer
Kristin Rivas is not a physician, psychiatrist, psychologist, or licensed mental health counselor. The services provided are not medical treatment, psychotherapy, or mental health counseling. They are not intended to diagnose, treat, cure, or prevent any medical or psychological condition and are not a substitute for professional medical advice, diagnosis, or treatment.
If you are experiencing a medical or mental health emergency, call 911 or contact your healthcare provider immediately. You are solely responsible for consulting with licensed medical or mental health professionals regarding any conditions that may require their care.
3. Eligibility
You must be at least 18 years of age to use this Website and purchase services independently. Individuals under 18 may receive services only with the written consent and signature of a parent or legal guardian on the Client Terms of Agreement form.
4. Service Offerings and Pricing
Pricing is subject to change. Any changes in pricing will not affect services already purchased or active engagements.
What's Included
Every session includes a follow-up email with either a video or an MP3 recording of the session (if desired), Amen Clinics Brain and Hormone Health Assessments with relevant coaching and supportive reinforcement materials.
5. Scheduling, Cancellation, and No-Show Policy
Scheduling
Sessions are scheduled through our online scheduling system at kristinrivas.intakeq.com/booking or by calling (206) 552-8374. We require at least 48 hours' notice for rescheduling.
Cancellation Policy
If a session is canceled with less than 24 hours' notice, you are a no-show, or you arrive more than 15 minutes late, you will be charged the full session rate or forfeit a prepaid session. True emergencies or sudden illness may be accommodated at Kristin's discretion.
If a free consultation is canceled with less than 24 hours' notice or is a no-show, it may not be rescheduled, or a $75 rescheduling fee may apply at Kristin's discretion.
6. Payment Terms
General
Payment is due at the time of service or according to the payment plan schedule for your selected program. We accept credit cards, debit cards, cash, and checks (payable to Kristin Rivas LLC). We securely store payment information on file to hold appointments and process scheduled payments.
Insurance
We do not accept insurance directly. Your insurance provider may reimburse you for hypnotherapy services, particularly with a physician's referral. We can provide a superbill upon request.
Refund Policy
Kristin Rivas LLC reserves the right to cancel and refund any payment for a program of sessions for any reason.
7. Disclaimer on Results
While hypnotherapy and related modalities can be highly effective, no therapeutic process is guaranteed. The success of your sessions depends on your openness, honesty, self-awareness, willingness to participate, and follow-through.
You accept all risks for any adverse reactions and release Kristin Rivas, C.Ht. and Kristin Rivas LLC from claims for liability and damages of any kind, including personal injury, emotional distress, and negligence (excluding willful misconduct). You expressly waive claims for indirect, consequential, or exemplary damages. In no event shall recovery exceed the aggregate amount paid by you to Kristin Rivas, C.Ht.
You agree to indemnify and hold Kristin Rivas, C.Ht. and Kristin Rivas LLC harmless for any damages, including attorneys' fees, arising from your breach of these Terms.
8. Session Recordings
With your consent, sessions may be recorded. Recordings are stored securely and remain strictly confidential between you and Kristin Rivas. Recordings are used solely for your benefit (sent to you as MP3 files) and for Kristin's professional reference or liability protection. Recordings will not be shared with third parties without your explicit permission.
9. Intellectual Property
All content on this Website — including text, graphics, logos, images, audio, video, course materials, guided meditation recordings, PDF resources, and the Connection To Purpose Course — is the property of Kristin Rivas, LLC or its licensors and is protected by applicable copyright and intellectual property laws.
You may not reproduce, distribute, modify, create derivative works from, publicly display, sell, or license any content from this Website without prior written consent from Kristin Rivas, LLC.
Session recordings provided to you are for your personal use only and may not be shared, published, uploaded, or distributed in any form.
10. Website Use
Acceptable Use
You agree to use this Website only for lawful purposes and in a manner that does not infringe the rights of others or restrict their use and enjoyment of the Website.
User-Generated Content
If any area of the Website permits user comments, reviews, or other submissions, you are solely responsible for your content. Kristin Rivas, LLC reserves the right to remove any content that is inappropriate, offensive, defamatory, or in violation of these Terms. Our total aggregate liability to you for any claims arising from or related to these Terms or our services shall not exceed the total amount you paid to Kristin Rivas, LLC in the 12 months preceding the claim.
Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under applicable law.
14. Dispute Resolution
Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Tennessee, without regard to its conflict of law provisions.
Informal Resolution
Before filing any formal claim, you agree to contact us at contact@kristinrivas.com to attempt to resolve the dispute informally. We will make good faith efforts to resolve the matter within 30 days.
Jurisdiction
If informal resolution is unsuccessful, any legal proceedings shall be brought exclusively in the state or federal courts located in the State of Tennessee. You consent to the personal jurisdiction of these courts.
14. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
15. Entire Agreement
These Terms, together with our Privacy Policy and the Client Terms of Agreement (signed prior to service delivery), constitute the entire agreement between you and Kristin Rivas, LLC regarding the use of this Website and our services. In the event of a conflict between these Terms and the signed Client Terms of Agreement, the Client Terms of Agreement shall prevail for matters related to service delivery.
